These Terms & Conditions apply to customers in Great Britain (England, Scotland and Wales) and Northern Ireland who use the Bella Boo Pro Beauty website or purchase products through our online store at www.bellabooprobeauty.co.uk.

Please read these Terms & Conditions carefully before using our website or placing an order.

Nothing in these Terms & Conditions is intended to exclude, restrict or limit any statutory consumer rights that apply to you under applicable UK, Northern Ireland or other mandatory consumer-protection law.

Where these Terms refer to “UK customers”, this includes customers in Great Britain and Northern Ireland.

Bella Boo Pro Beauty sells nail products, hair products, nail tools and accessories, beauty products and certain electrical equipment intended for nail use.

We make reasonable efforts to ensure that product descriptions, photographs, colours, specifications and other information displayed on our website are accurate and up to date.

Colours shown on a computer, tablet or mobile device may vary slightly from the actual product depending on your device and display settings.

All products are subject to availability.

We reserve the right to update product information, specifications or availability where reasonably necessary.

Any changes made after you have placed an order will not affect an order that has already been accepted, except where permitted or required by law.

Where products are regulated by specific UK or Northern Ireland product-safety or cosmetics legislation, we will comply with the requirements applicable to the relevant market.

Where we cannot supply a product that you have paid for, we will provide an appropriate refund or other remedy in accordance with applicable law.

5. Placing an Order

When you place an order through our website, you are making an offer to purchase the products selected by you.

Before completing your purchase, you will have the opportunity to review your order and correct any errors.

You should check your order carefully before submitting it.

When you submit an order, you agree to pay the applicable product price, delivery charges and any other charges clearly displayed before you complete your purchase.

6. Order Confirmation and Acceptance

Prices and any applicable taxes will be displayed as required by law.

Any applicable delivery charges and other mandatory charges will be displayed before you complete your purchase.

We reserve the right to change prices at any time.

Price changes will not affect an order that has already been accepted, except where there has been an obvious error or where otherwise permitted or required by law.

For customers in the UK, any applicable VAT, customs duty or other import charges will be dealt with in accordance with the applicable UK tax and customs rules.

Where charges are payable by the customer after dispatch, we will provide information about this before purchase where required by law.

8. Payment

We accept the payment methods displayed on our website at the time of purchase.

Payment must be successfully authorised before an order can be processed.

You must provide accurate billing and payment information.

Payments may be processed through third-party payment providers. Your use of those payment services may also be subject to the provider's own terms and policies.

9. Delivery to Great Britain and Northern Ireland

We use Evri and/or other delivery providers as applicable to deliver orders.

We make reasonable efforts to deliver orders within the estimated delivery timeframe shown at checkout.

Delivery timeframes are estimates unless a specific delivery date has been expressly agreed.

For UK consumer orders, goods will generally be delivered within 7 days unless a different delivery period has been agreed with you or a different period is permitted by applicable law.

We cannot be held responsible for delays caused by circumstances outside our reasonable control, including courier delays, severe weather, transport disruption, strikes, customs delays, road closures, government restrictions, telecommunications failures or other unforeseen events.

Where a delay occurs, we will make reasonable efforts to assist you and, where appropriate, contact the relevant delivery provider to investigate the delay.

Nothing in this section limits your statutory rights relating to delayed delivery or non-delivery.

Where delivery to Northern Ireland carries an additional charge, that charge will be clearly displayed before you complete your purchase.

10. Risk in the Goods

Where you are a consumer, responsibility for the goods generally passes to you when you, or a person nominated by you other than the carrier, physically takes possession of the goods.

We remain responsible for the goods until that point, subject to applicable law.

11. Returns and Cancellation Rights

   11.1 Change-of-Mind Cancellation

If you are a consumer purchasing goods online, you generally have a statutory right to cancel your contract within 14 calendar days after the day on which you, or a person nominated by you other than the carrier, receives the goods.

You do not normally have to give a reason for exercising this cancellation right.

The cancellation right is subject to statutory exceptions, including certain goods that are sealed for health or hygiene reasons where the seal has been removed.

UK distance-selling rules require information about cancellation rights to be provided to consumers and generally allow 14 days to cancel qualifying online purchases.

To cancel your order, you must clearly notify us of your decision to cancel before the end of the applicable cancellation period.

You may contact us by email or use the model cancellation wording included in these Terms & Conditions.

After notifying us of cancellation, you generally have a further 14 days to return the goods.

   11.2 Cost of Returning Goods Following Change of Mind

Unless otherwise required by law, you are responsible for the direct cost of returning goods when cancelling because you have changed your mind.

You are responsible for ensuring that returned goods are packaged appropriately and safely.

We recommend using a tracked delivery service when returning goods because you are responsible for the goods until they reach us.

   11.3 Condition of Returned Goods

You may handle goods only to the extent necessary to establish their nature, characteristics and functioning.

If goods have been handled beyond what would reasonably be permitted in a shop, we may be entitled to make a deduction from the refund to reflect any resulting reduction in value, where permitted by law.

This does not affect your statutory rights where goods are faulty, defective, damaged, incorrectly supplied or otherwise do not conform to the contract.

   11.4 Refund Following Change-of-Mind Cancellation

Where you validly cancel an eligible online order, we will reimburse the payments we are legally required to refund.

Where applicable, this includes the cost of our standard delivery service originally paid for the order.

If you selected a more expensive delivery option than our least expensive standard delivery option, we are not required to refund the additional amount attributable to the more expensive delivery method.

We will normally issue the refund using the original payment method.

We may withhold reimbursement until we have received the returned goods or you have supplied evidence that the goods have been returned, whichever occurs first, where permitted by law.

12. Products Excluded from the Change-of-Mind Cancellation Right

Certain products may be excluded from the statutory right to cancel for health, hygiene or other legal reasons.

Depending on the nature of the product, this may include products such as:

  • Cosmetics;

  • Nail products;

  • Beauty products;

  • Skincare products;

  • Personal-use beauty accessories;

  • Certain opened or used beauty tools; and

The cancellation exception applies only where the applicable law permits it.

We will not use a hygiene exception to remove or restrict your statutory rights where a product is faulty, defective, damaged, incorrectly supplied or otherwise does not conform to the contract.

Consumers in Northern Ireland also have statutory cancellation rights for qualifying online purchases, subject to applicable exceptions.

13. Wrong Product, Shade, Colour, Size or Variation

Please check your order carefully before completing your purchase.

If you have selected the wrong product, shade, colour, size or variation, this may be treated as a change-of-mind return where the statutory cancellation right applies.

If you have received a product that is different from the product you ordered, please contact us.

A product supplied incorrectly by us will not be treated as a change-of-mind return.

14. Order Cancellations Before Dispatch

If you wish to cancel an order before it has been dispatched, please contact us as soon as possible.

We will make reasonable efforts to accommodate cancellation requests received before dispatch.

However, because orders may enter processing quickly, we cannot guarantee that a cancellation request can be completed before dispatch.

If the order has already been dispatched, the applicable statutory cancellation and return rules will apply.

15. Faulty, Damaged, Defective or Incorrect Products

If your order arrives:

  • Damaged during transit;

  • Faulty;

  • Defective;

  • Not as described;

  • Not fit for its intended purpose;

  • Unsafe; or

  • Different from the product you ordered,

please contact us as soon as reasonably possible.

We ask that you contact us within 48 hours of delivery where possible, particularly where goods have been damaged during transit, so that we can investigate the issue promptly.

However, failure to contact us within 48 hours does not remove or restrict any statutory consumer rights.

To help us resolve the issue quickly, we may ask you to provide:

  • Your order number;

  • Clear photographs of the product;

  • Clear photographs of the packaging;

  • A description of the issue; and

  • Where appropriate, photographs or video demonstrating a fault.

These requests are for investigation purposes and do not replace or restrict your statutory rights.

16. Your Statutory Rights for Faulty Goods

Goods supplied to UK consumers must comply with applicable statutory requirements, including being of satisfactory quality, fit for purpose and as described.

For customers in Great Britain, the Consumer Rights Act 2015 provides statutory remedies where goods do not conform to the contract, including the applicable short-term right to reject goods.

For customers in Northern Ireland, applicable consumer law also provides statutory rights where goods are not of satisfactory quality, are not fit for purpose or are not as described. Northern Ireland consumer guidance confirms a 30-day period for qualifying faulty goods claims, subject to the applicable legal rules and exceptions.

Depending on the circumstances and applicable law, you may be entitled to:

  • A refund;

  • A replacement;

  • A repair;

  • A price reduction;

  • Rejection of the goods; or

  • Another appropriate statutory remedy.

We will not require you to accept a repair, replacement or other remedy where the law gives you a different right.

17. Return Costs for Faulty or Incorrect Goods

Where goods are faulty, defective, damaged, incorrectly supplied or otherwise do not conform to the contract, we will deal with return costs in accordance with your statutory rights.

Where the law requires us to cover reasonable return costs, we will do so or reimburse you for reasonable costs that you have paid upfront.

You should contact us before returning faulty or incorrect goods where reasonably possible so that we can provide return instructions.

18. Damage Caused by Misuse or Improper Use

We are not responsible for damage caused by:

  • Misuse;

  • Accidental damage;

  • Improper installation;

  • Failure to follow manufacturer instructions;

  • Unauthorised modification;

  • Unauthorised repair;

  • Normal wear and tear; or

  • Use of a product for a purpose for which it was not intended.

This does not affect your statutory consumer rights.

19. Electrical Products

Certain products sold by Bella Boo Pro Beauty are electrical nail products or equipment.

Electrical products must be used in accordance with the manufacturer's instructions and safety information.

Customers should ensure that products are suitable for the intended use and electrical supply before use.

If an electrical product develops a fault, stop using it and contact us.

Do not attempt to dismantle or repair an electrical product unless this is expressly permitted by the manufacturer.

Nothing in this section limits your statutory rights relating to faulty, defective or unsafe electrical products.

20. Cosmetics and Beauty Products – UK Requirements

Some products sold by Bella Boo Pro Beauty may fall within UK cosmetics legislation or other product-safety legislation.

Where products are made available in Great Britain (England, Scotland and Wales), applicable cosmetic-product requirements must be complied with before the products are placed on the GB market.

This may include requirements relating to a Responsible Person, product safety assessment, Product Information Files, labelling, ingredient information and notification to the relevant UK authorities.

Where products are made available in Northern Ireland, the applicable Northern Ireland/EU cosmetics requirements may apply.

Customers should follow all product instructions, warnings and safety information supplied with cosmetic and beauty products.

The UK Government confirms that cosmetic products made available in GB must comply with the applicable GB cosmetics regime, including requirements concerning a Responsible Person and notification. Separate requirements apply to Northern Ireland.

21. Promotions and Discount Codes

From time to time, we may offer promotional prices, discounts or discount codes.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash;

  • Discount codes cannot be combined with other discount codes;

  • Discount codes may have expiry dates or product exclusions;

  • Promotional offers are subject to availability; and

  • Discount codes cannot normally be applied retrospectively to completed orders.

We reserve the right to withdraw or amend a promotion where there is a legitimate reason to do so, including where an offer has been published incorrectly.

We will not use a promotional term to exclude or restrict statutory consumer rights.

27. Events Outside Our Reasonable Control

We will not be responsible for delays or failures caused by circumstances outside our reasonable control, such as:

  • Severe weather;

  • Fire;

  • Government action;

  • Major transport disruption;

  • Significant telecommunications failures;

  • Significant internet failures;

  • Customs disruption; or
